Layout and copy on Clear Blue Seas Ltd. web site

The presentation and design of the Clear Blue Seas Ltd. web site is the exclusive responsibility of Clear Blue Seas Ltd. It reserves the right to edit copy or amend the layouts or photographs supplied, should it be considered necessary. It also reserves the right, at any time, to amend and edit copy, hypertext links etc. (Clear Blue Seas Ltd. reserves the right to charge for any hypertext links) entered into the Clear Blue Seas Ltd. online database by advertisers. Clear Blue Seas Ltd. cannot be held responsible for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by the customer.

Accuracy

Clear Blue Seas Ltd. cannot accept any legal responsibility for the accuracy of the advertisements, or any alleged breaches of contract on an advertiser's part and the advertiser indemnifies Clear Blue Seas Ltd. against all costs, expenses and losses arising out of a claim relating to the content of an advertisement. Advertisers are fully responsible for ensuring the information they submit is accurate to the best of their knowledge. Advertisers will be responsible for keeping their availability accurate and up-to-date at all times.

Photographic materials

Clear Blue Seas Ltd. will make every effort to safeguard all materials supplied, and return them if required, but cannot be held responsible for any loss or damage, however caused, and for any loss or damage sustained. Every effort will be made to ensure accurate reproduction of all advertisements submitted, but Clear Blue Seas Ltd. cannot be held responsible for any loss or damage or otherwise resulting from errors or omission.

Liability

The Clear Blue Seas Ltd. web site will be live and functioning properly at virtually all times. However, there will be occasions when the site will contain errors, or may be interrupted by issues such as server technical problems. Clear Blue Seas Ltd. cannot be held responsible to any advertiser for such issues, consequential, incidental or indirect damages, including lost profits. When the owner's property is advertised on our online booking facility, it is their responsibility at all times to ensure that the correct availability is always entered.

The owner agrees to pay to Clear Blue Seas Ltd. 100% of any costs that may be incurred by Clear Blue Seas Ltd., through courts or any other means as a result of refusal to accept an online booking from Clear Blue Seas Ltd... This applies to any circumstance where the owner's property appears on the Clear Blue Seas Ltd. sites.

Copyright

Clear Blue Seas Ltd. shall be entitled to reproduce part or whole of any photographic material supplied by the advertiser. It claims copyright to the electronic images of the photographic material supplied by advertisers. It is the advertiser's responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser confirms that he or she is the owner of the copyright in such material, or is authorised by the owner thereof to grant to Clear Blue Seas Ltd. the rights therein contained. Clear Blue Seas Ltd. cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers and the advertiser indemnifies Clear Blue Seas Ltd. against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser. Clear Blue Seas Ltd. cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers.

Substitution of properties

An advertisement relates to a specific property. The property in an advertisement may not be substituted by another property.

Advertising more than one property on one advertisement

Each advertisement on the Clear Blue Seas Ltd. site must represent the individual property where people will spend their holidays - not examples of similar places. Only one property can appear on each advertisement, unless it is a property with multiple rental units on the same site, and additional advertising units are purchased.

Termination of advertising

If advertisers wish to have their advertisement removed from our site prior to the end of their subscription period, this can be done, but no refunds will be paid. Clear Blue Seas Ltd. reserves the right to refuse any advertisement for its web sites, and will not be liable for any loss or expense in so doing. If an advertiser attempts to enter unsuitable material into the Clear Blue Seas Ltd. on-line database, or persistently misuses the on-line systems, Clear Blue Seas Ltd. reserves the right to remove the property from the its sites, without notice and without refund. If Clear Blue Seas Ltd. receives a complaint from a person who has rented an advertiser's property which Clear Blue Seas Ltd., acting reasonably, consider is justified, or an advertiser knowingly double-books a property, or engages in any unacceptable practices or is in breach of its obligations to Clear Blue Seas Ltd., then it reserves the right to remove the property from the web sites without notice.

Payments to Clear Blue Seas Ltd.

Payment for advertising can be made in British Pounds by major credit and debit cards, or a cheque on a UK bank in British Pounds. Or in Euros by transfer to Clear Blue Seas Ltd. European Euro account.

Legal jurisdiction

These terms and conditions are governed by English law and advertisers accept the exclusive jurisdiction of the English courts to rule on any disputes.

Payment to Owners

All payments will be transferred to owners a minimum of 2 weeks before departure by bank transfer.
